Applicability
VIRTUAL ARENA is a product of Erlebniscenter Basel. These General Terms and Conditions (hereinafter referred to as GTC) govern the relationship between Erlebniscenter Basel (hereinafter referred to as the operator) and the registered or unregistered user of the VIRTUAL ARENA platform (hereinafter referred to as the user).
A user is any natural or legal person who accesses the content and services of VIRTUAL ARENA. By using the VIRTUAL ARENA and the associated services, the user declares that they agree to the terms and conditions.
The operator reserves the right to change these terms and conditions at any time and without stating reasons. Changes come into force immediately after they are posted. By continuing to use the services and products after the amended terms and conditions have come into force, the user declares that they agree to them.
Membership
As soon as the user registers with VIRTUAL ARENA, he is considered a member. He will be provided with a personal account with a username and password; usernames and passwords may not be shared, and the member is responsible for keeping them secure. Registration under a false name and first name, false address, false date of birth and false email accounts is not permitted.
The member undertakes to indemnify the operator for any damages, including claims by third parties and consequential costs of any kind, if he violates the terms and conditions. The operator and the member are entitled to terminate the membership at any time without stating reasons. Upon termination, all data stored for the member’s account will be deleted.
Termination of membership and deletion of stored data can be requested at any time in writing (Erlebniscenter GmbH, Münchensteinerstrasse 274a, 4053 Basel, Switzerland) or by email (info@erlebniscenter.ch).
Buying tickets
By confirming the purchase on the VIRTUAL ARENA website basel.virtual-arena.ch or erlebniscenter.ch, a binding purchase contract is concluded. This cannot be revoked, amended or cancelled by the customer. The game, date and time of entry, number of tickets and price are thus fixed. The purchase price for all tickets purchased is due upon confirmation of the purchase. The purchase price can be paid with a valid credit card, Google Pay, Apple Pay or cash on site (on the date of purchase). The buyer is obliged to provide the information requested during the purchase process in full. The right is reserved to check the eligibility of the ticket holder. Discount codes and promotions are valid individually and cannot be cumulated. If duplicates or fraudulent activity are suspected, the operator reserves the right to reject all tickets.
Cancellation and postponement
There will be no refund of the purchase price. Instead, vouchers for the VIRTUAL ARENA will be issued in all cases. Cancellation must always be made by email to event@paradiesgolf.ch. Postponements or cancellations up to 30 days before the booking date are free of charge. Up to 14 days before the booking date, 50% of the purchase price will be issued as a voucher. Up to 7 days before the booking date, 25% of the purchase amount will be issued as a voucher. There will be no refund for less than 7 days.
Offers that are discounted cannot be postponed or refunded.
Default of payment
The operator shall charge a processing fee of CHF 25 for the second reminder and a processing fee of CHF 50 for the third reminder. If reminders are unsuccessful, the invoice amounts can be assigned to a collection agency. The collection agency will assert the outstanding amounts in its own name and for its own account and may charge additional processing fees.
Copyright
The information available on the operator’s websites (basel.virtual-arena.ch or erlebniscenter.ch) is protected by copyright. Any use outside of the VIRTUAL ARENA is only permitted with the consent of the operator. The user or member agrees that the content created by him/her and intended for publication may be made available to third parties, duplicated or published elsewhere by the operator.
Disclaimer and terms of use
Although the operator only uses the most modern technology, it cannot be ruled out that dizziness, cramps, blackouts, nausea, visual disturbances, eye pain, orientation and consciousness disturbances, headaches and even epileptic seizures may occur when using the VIRTUAL ARENA. If you have been diagnosed with any of the above conditions, you are advised not to use the VIRTUAL ARENA. If you experience any of the above symptoms while using the VIRTUAL ARENA, you are strongly advised to stop using it immediately. The operator’s employees are authorised to immediately interrupt or prevent further use at the first sign of the above-mentioned adverse effects.
The VIRTUAL ARENA is not recommended for the following groups of people:
women in an advanced stage of pregnancy, people with heart conditions, people with serious illnesses, people with severe mental illnesses, people prone to seizures and epilepsy, people who are physically and/or mentally sensitive to rapid image sequences, rapid movements or electrical fields. The operator also reserves the right to exclude individuals from use in individual cases. This is particularly the case if:
- persons are under the influence of alcohol or other mind-altering substances,
- persons behave in a disturbingly loud manner despite repeated warnings and thus disturb other customers,
- persons behave aggressively, xenophobically, provocatively or in any other inappropriate manner towards staff or other guests.
In the cases described, there will be no refund or partial refund due to limited or non-use.
If one or more of the above restrictions apply, the user must inform the operator’s employees of this before the start of the game or at the time of booking. The same applies to known phobias or other problems, such as a fear of heights.
Use of the services of the VIRTUAL ARENA is at the user’s own risk. If the services are used by minors, an adult must be present. Ideally, this should be a parent or guardian who acknowledges the safety instructions by providing written confirmation to the operator. In this way, the adult assumes full responsibility for use of the services at their own risk.
The operator reminds all parents and group supervisors to carefully fulfil their supervisory duties, as we cannot release you from them. In this context, supervisors and parents are also responsible for any damage caused by those they are supervising.
- The following conditions apply to the use of the VIRTUAL ARENA:
- The VIRTUAL ARENA is restricted to users who are eighteen (18) years or older. By using the services, users assure and guarantee the operator that:
- they are at least eighteen (18) years old;
- they have read and understood the terms of this agreement and agree to be bound by the terms of this agreement;
- if you are entering into this agreement on behalf of your employer, you are legally authorised to enter into this agreement by your employer and have the authority to bind your employer to this agreement
- Your use of the Services does not violate any law, rule or regulation applicable to you or your employer, or any terms, conditions or requirements posted by any Third Party Service (as defined below). Certain features of the Services may, where indicated, be subject to age and/or other eligibility requirements and restrictions. If you are a user under eighteen (18) years of age or are not yet of legal age in your country, please review this Agreement with a parent or legal guardian. Your parent or legal guardian should agree to this Agreement on your behalf, and all users under eighteen (18) years of age or under the age of majority are advised to use parental discretion.
- When using the VIRTUAL ARENA, these rules must be strictly adhered to:
- Virtual obstacles must never be crossed and should not be touched if possible. In the event of unintentional non-compliance, points may be lost. In the event of intentional non-compliance, the player may be removed from the arena.
- Keep an arm’s length between yourself and virtual obstacles and other players at all times.
- Virtual spatial boundaries must be observed at all times.
- Leaning, propping, etc. on virtual (i.e. not physically present) objects must be avoided at all costs.
- If you feel unwell, nauseous or dizzy, take off the VR headset immediately and contact the specialist staff immediately.
- Avoid very fast movements if possible. We recommend walking at a fast pace rather than running.
- Before crossing virtual doors, intersections or corners, be sure to slow down and proceed with caution.
- Do not stretch out your arms in the immediate (virtual) vicinity of other players. Try not to touch other players.
- Approach other players carefully, avoid scaring them. If a player’s virtual avatar loses all three hearts, they must carefully return to their personal safety zone and may not influence other players. Non-compliance can result in the loss of points. Multiple non-compliance can result in expulsion.
- Players will be charged for any wilful damage to VR hardware resulting from non-compliance with the above rules.
Liability of the operator
The operator declines all liability for damages resulting from the use of the VIRTUAL ARENA and the associated website and links. The information published on the website is subject to change at any time. The operator assumes no liability for its accuracy. The operator is not liable for unauthorised access to personal user data by third parties (e.g. unauthorised access to the database by hackers). The operator is also not liable for the misuse by third parties of data and information that users themselves have made available to third parties.
The operator shall not be held liable for any damage to health or property resulting from uncontrolled body movements and falls. No liability is accepted for items of clothing or valuables. Visitors are responsible for handling the hardware provided to them for the duration of their stay with due care. Visitors/users shall be personally liable for any damage caused by improper use or wilful destruction.
The operator is not liable for damages caused by force majeure, riots, war and natural disasters, as well as strikes, lockouts, traffic disruptions, power failures, internet/network failures, computer or programme crashes and similar/comparable events for which the operator is not responsible.
Severability clause
If a competent authority should consider one or more provisions of these GTC to be void or ineffective, the binding nature of the remaining provisions shall remain unaffected. In this case, the void or ineffective provision shall be replaced by a legally valid provision that is as economically equivalent as possible. The same applies to any gaps.
Applicable law and place of jurisdiction
Swiss law applies exclusively. The place of jurisdiction is Basel.
